CONSUMER ALERT- PALM SPRINGS AND SAN DIEGO BASED WICR WATERPROOFING ALSO OWNS DECK INSPECTOR INC THAT TOGETHER ARE TERRORIZING THEIR CLIENTS.

I have heard from several clients of Deck Inspector inc and or WICR waterproofing who have told me horror stories about David Mazor’s tactics. Threats that if they don’t “fix balconies” that they will send a report to the city saying that the decks are dangerous etc. David likes to use his wife’s law firm lindborg and Mazor LLP to bully clients. I can’t give you legal advice but I would tell you to go get legal advice and do not allow WICR or David Mazor try to push you around. I would encourage you to file complaints with the CSLB the attorney general’s office as well as the department of consumer affairs. If you receive threatening letters from his attorneys I would suggest that you go to the state bar and file complaints against them.

Is it a conflict of interest to do deck inspections under the balcony bill laws in California without disclosing that the company you are being referred to make the repairs or do the destructive testing is owned by the same person?

Do your research before you contract with anyone for balcony inspections and make sure that there are no conflicts of interest with your inspector and if there are, to spell them out so you have full knowledge and the ability to make prudent business decisions.

Deck Inspector LLC in S California is owned by David Mazor who owns WICR waterproofing and I am told that he and his apparent grifter sin Sean Krubinski are not disclosing that crucial fact to their clients. It’s a matter of ethics. Clicking the links below will show that both entities are owned by David Mazor and leave little doubt for consumers about the actual conflicts of interest.

Confidential sources tell us that Deck Inspector LLC is failing decks with even a small crack, demanding that they must make repairs immediately and WICR is charging fees that are exceedingly high. Unless a deck has structural issues that are life threatening, decks can be repaired on the property management company or HOA’s decision within a reasonable time.

Remember, investigate your inspection company and make sure they are independent with no conflicts of interest.

See our page of independent and unbiased balcony inspectors that have been vetted and determined to have no conflicts of interest in doing balcony inspections by clicking here QUALIFIED Deck Inspector’s FOR SB 721 & SB 326 DECK INSPECTIONS

I would also warn consumers that if Mark Marsch Consulting is involved, he has close personal relationships with ownership of these companies and was found to be a biased expert by a Judge in San Bernardino Superior Court.

These links go to the California Secretary of States website and are recent filings clearly showing the same owner on both business listings.

Wanke, Industrial, Commercial, Residential, Inc. Is No Longer a Listed Applicator for Mer-Kote!

Did Hell freeze over? I missed it I guess…

during a website update at DeckExpert.com, I was posting the Mer-Kote approved applicators list to the deck coating installers page…and I noticed that it had been revamped into a easier to read list…and then I was reading the list of applicators…and then I noticed that Wanke Industrial Commercial Residential  wasn’t listed.

I inquired with a source at Mer-Ko who confirmed that Wanke Industrial Commercial Residential Inc is not a listed applicator anymore.

Wanke Industrial Commercial Residential was the grandaddy installer of Mer-Kote; in the days when one certain sales manager for Mer-Kote ran things, Wanke Industrial Commercial Residential was THE Mer-Kote applicator, a force to be reckoned with…allegedly due to his hidden ownership of the company.

However, The former salesperson of Mer-Kote was fired after Parex bought them as he refused to sign his employment contract, and things changed for the better at Mer-Kote with new management and a new way of doing business…less good ole boy style and more like an open and free market.

So how does that effect you Mr. Homeowner or Homeowner Association? Well that’s better left to be said by Mer-Kote, but my opinion is that any warranty written by Wanke Industrial Commercial Residential, if it meets Mer-Kotes standards and was registered with mer-Kote, is that your ok. You’ll need to have your decks maintained by a listed applicator. Wanke Indutrial Commercial Residential  cannot back any factory warranty up so far as I know…

If your warranty is written and backed by Wanke Industrial Commercial Residential, you’re at their mercy…check with Mer-Kote and see what might be done…bring or send a copy of your warranty to them.

Listed applicators for Mer-Kote can be found at Mer-Kote’s website.

A "NEW" Manufacturer, NEVADA COATING SYSTEMS, Makes It’s Online Debut

, Da
Browsing the web this weekend, I saw that Wanke Industrial Commercial Residential Inc,  had finally put up their website…looking through, I saw they were a “Nevada Coating Systems” applicator…so I clicked the link to see what was there.

Nevada Coating Systems is an entity using an address down in Rancho Mirage, so I googled the phone/address and found that it is linked to a former Mer-Ko salesman and ex Roof Consultant Institute member who now owns the company under a different albeit similar name. We would warn consumers to do their research and background checks at CSLB, Yelp!, BBB and Google.

NCS is advertising their coatings for decks, liners, pools and many other areas that don’t really interest me as I’m not in that line of work…they appear to have a Polyurea system, a 2 component system that is in heated tanks and is sprayed on using a gun that mixes the 2 parts as it’s sprayed.

Polyureas have their place in many applications and their fast drying/curing makes a tough competitor for some other coating sytems for various applications…I’m just not convinced of it’s use on decks as a long term solution…but that’s just my opinion.

Despite an impressive array of testing done, the 2 most important tests for deck coatings at least, appear to be missing-Class A and One Hour Fire Testing. There is no that I can find at ICC-ES in Div 7 Traffic Coatings and so I would say that in my opinion, this product would not be a suitable candidate for decking where residential codes must be met. Ask about E109 and E119 testing when inquiring…

The stuck in my craw thing about NCS is their “sample warranty” which is more of a service contract, and the way it’s written might be a Sherman Act or Magnuson Moss issue…at least in my opinion from reading through the FTC’s website. Click here to read some interesting info on warranties and service contracts at the FTC website. I dunno, it’s just a really stacked in the installers/mfg’s favor warranty…the odds are far better for you to put it all on black in Vegas…

Attached is a picture of their warranty with my notes on it. We are publishing this under the Fair Use doctrine and have the right to publish, criticize, comment on and satirize it if we want, all protected by the doctrine of Fair Use. So despite the terms of use at their website…it’s a constitutionally protected use.

As of now, with the way this warranty is written, it’s a bad deal for consumers in my opinion. It ties you to the original applicator for 10 years, giving them residual income for resealing your decks every 3 years…you get no choice as a consumer to have who you want service the decking. Imagine buying a Ford and you got the best deal at one dealer, but don’t really like their service dept., but your warranty said you have to use that dealer, and that dealer only… pretty crappy terms.

This warranty is similar to the old Mer-Ko “warranty”, whose terms were changed as soon as new Mer-Ko management could.

My opinion is to search elsewhere for other coating options due to the warranty restrictions.

Former Mer-Kote Employee Busy in Court

Former Mer-Kote salesperson, now owner of the company known under it’s previous name of Wanke, Industrial, Commercial Residential Inc under Fred Wanke,  has been busy in court lately, judging from our review of cases in the So Cal court system.

A suit filed against former employer Mer-Ko Parex/LaHabra resulted in some type of settlement from what we can tell from the information at the court website,

and in Riverside County, an ongoing suit under the Negligence category has Mr. Krubinski listed as a plaintiff and a defendant, along with long time Mer-Ko applictator Wanke Industrial Commercial Residential, Inc listed as the same thing, plaintiff and defendant.

Looks like there will be some interesting twists and turns on this case…

see below for the public information I was able to find on court web sites.
